Liability Waiver for Heidi Kassner Yoga, LLC

Please read this document carefully before participating in any classes, workshops, or activities offered by Heidi Kassner Yoga, LLC (hereafter referred to as "HKY"). By signing up for class or making a purchase, you agree to the terms and conditions outlined below.
Assumption of Risk: I understand and acknowledge that participation in yoga classes, workshops, and related activities involves inherent risks, including but not limited to, physical injury, muscle strains, sprains, falls, and other unforeseen hazards. I am voluntarily participating in these activities with full knowledge of the potential risks involved and agree to assume all risks associated with my participation. The Activities may be offered in the physical location of HKY or offered online by videos, television, podcasts, apps or other digital media or platforms. All of such offerings, either physical or online, shall be considered “Activities.”
Health and Physical Condition: I recognize that I must be in adequate physical and mental health to participate in the Activities. I understand that the Activities may require intense physical exertion, and I represent and warrant that I am physically fit enough to participate, and I have no medical condition which would prevent my full participation in the Activities. I recognize that the Activities may cause or aggravate a physical injury or medical condition. I understand that it is my responsibility to consult with a physician before my participation in the Activities. If I have done so, I have taken the physician’s advice. I understand that HKY reserves the right to refuse my participation in any Activity on medical, fitness or any other grounds. I understand my physical limitations and I am sufficiently self-aware to stop or modify my participation in any Activity before I become injured or aggravate a pre-existing injury. 
Release and Waiver of Liability: In consideration of being permitted to participate in the activities offered by HKY, I, for myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge HKY, its instructors, employees, agents, and owners from any and all claims, demands, liabilities, damages, costs, and expenses arising out of or in connection with my participation in any activities, including but not limited to, injuries, losses, or damages sustained as a result of negligence on the part of HKY or its representatives. In consideration of being permitted to participate in the Activities, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities at HKY, including those which may result from the negligence of the HKY. In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any “Claim” (as defined below) I may have against HKY, its owners, managers, teachers, instructors, workshop presenters, employees, independent contractors and staff (each, a “Released Party”) that I may sustain as a result of participating in the Activities at HKY even if the Claim arises from the negligence of any Released Party or anyone else. I agree to indemnify and hold harmless each Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of any Released Party or anyone else. “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of a Released Party.
Indemnification: I agree to indemnify and hold harmless HKY, its instructors, employees, agents, and owners from any and all claims, demands, liabilities, damages, costs, and expenses, including attorney's fees, arising out of my participation in HKY's activities or my breach of this waiver.
Personal Property: I understand that HKY is not responsible for any loss or damage to my personal property while on the HKY premises or during any HKY-related activities.
Consent to Medical Treatment: In the event of an emergency, I authorize HKY and its representatives to seek and obtain medical attention on my behalf, and I agree to be responsible for any costs associated with such medical treatment.
Agreement to Follow Instructions: I agree to listen to and follow all instructions given by HKY instructors during classes and activities. I understand that failure to do so may result in injury or may lead to my removal from the class or activity.
Consent to Cancellation Policy: I agree to the class cancellation policy of cancelling or rescheduling within 4 hours prior to the start of class for a full refund or for your class pass to be returned to your account. No refunds will be made for cancellations less than 4 hours before class time, or not showing up for class without notification. Cancel or reschedule by emailing heidi@heidikassneryoga.com. Due to small class sizes, prior registration is required to hold your spot.
Consent to Photography For Marketing: I hereby understand that HKY, from time to time, may photograph, video, or otherwise record classes or events occurring at HKY and place such photographs and videos on its Website or social media platform. I hereby consent to the use of my image that may appear in any such photograph or video.
Acknowledgment of Understanding: I have read and fully understand the terms and conditions of this Liability Waiver. I acknowledge that I am signing this agreement voluntarily and without any inducement or assurance. I agree to abide by all HKY policies and procedures. By signing up for class or making a purchase, I agree to all terms and conditions outlined above.
